How Do We Use This Information In Our Business

Applicants – Upon registering your details and information with us, we will store them securely on our servers under the terms of consent for a term of six months after our last correspondence with you, unless you request they are removed prior to this time frame. Your data is solely used by James Gesner Estate Agents to enable us to keep you informed of properties meeting the criteria you have specified. We will hold your name, contact details and a copy of any correspondence we have had.

Viewers – Should you visit a property with us, we will be required to retain your information for up to 7 years from your last viewing with us under the terms of Legitimate interest, as required by Allianz Insurers. We collect your name, contact details, property search requirements, and any correspondence we have had. The data will be stored on our secure servers and will only be shared with Allianz insurers upon specific request of your record.

Buyers – Should you make an offer or buy a property through us we will take further data from you due to our legal obligation. We will require proof of finances and ID to conform with Anti Money Laundering Regulations 2017, alongside all the previously collected data. This information will be stored in hard copy form in our locked filing rooms should an offer be accepted. With your agreement, we will share you details with our preferred solicitors, so they may provide you with a quote, local surveyors, and our Mortgage advisor. We will also need to share your name and address with the owners and their solicitor for the contract. We will retain our files, and your details for seven years to conform with our legal obligation under the Estate Agents Act 1979.

Valuations – Upon requesting a valuation from us we will take your name, contact details, address and property details, and we will also ask to understand your plans going forward. This information is for the sole use of James Gesner Estate Agents and will not be shared outside of the firm. We will collect this information under the terms of contract and will retain this information digitally on our secure servers for five years after our appointment, so we may honour any quote made to you going forward.

Vendors – We are legally obliged to take your name, address and contact details and proof of ID for fulfilment of our contract with you and to comply with the Anti Money Laundering Act of 2017. Details of your property will be shared with outside digital platforms including (but not exclusively) Rightmove, Zoopla and On the Market.com to aid in the marketing of your home and the best fulfilment of our contract with you. With your agreement, we will share your details with our selected solicitors, local surveyors and our mortgage advisor. We will also need to share your name and address with the buyers and their elected solicitor for the contract. Your contact details will be kept both digitally on our secure servers, and in our locked file rooms for seven years to comply with the Estate Agents Act 1979.

Landlords - We are legally obliged to take your name, address and contact details and proof of ID for fulfilment of our contract with you and to comply with the Anti Money Laundering Act of 201. We will also hold your bank details and account, which we may share with government regulators upon request. Details of your property will be shared with outside digital platforms including (but not exclusively) Rightmove, Zoopla and On the Market.com to aid in the marketing of your home and the best fulfilment of our contract with you. With your agreement, we will share your details with our selected maintenance contractors. We will also need to share your name and address with the Tenants via the tenancy agreement and your contact details if you are maintaining the property yourself. Your contact details will be kept both digitally on our secure servers, and in our locked file rooms for seven years to comply with the Estate Agents act 1979.

Tenants - Should you rent a property through us we will take further data from you due to our legal obligation. We will require ID and copies of Visas where applicable to conform with Anti Money Laundering Regulations 2017 and Immigration Act 2014, alongside all the previously collected data. This information will be stored in hard copy form in our locked filing rooms should an offer be accepted. We will share this data with “Van Mildert Tenant Referencing”, who will contact you and take further personal information. Should we manage your property, we will share your details with our preferred maintenance contractors to fulfil our duty to maintain the property and maintain a safe environment for our tenants. We will also need to share your name and address with the owners via the tenancy agreement, and should they be maintaining the property themselves then we will pass on your contact details. We will retain our files, and your details on them for seven years to conform with our legal obligation under the Estate Agents Act 1979.

Contractors – Should you agree to undertake work for our business, we will take your business details and contact details, in some circumstances these will be passed to tenants to arrange access. We will hold these details along with your account details for the duration of any guarantees provided for your most recent works. We will also keep any invoices for the duration of our management of a property you have worked in, and seven years afterward due to our legal obligation under the Estate Agents Act 1979. These details will be retained in our locked file rooms.

Your Rights Over Your Information

By law, you can ask us what information we hold about you, and you can ask us to correct it if it is inaccurate. If requested we can delete it completely under the GDPR "right to be forgotten" regulation.

You can also ask us to give you a copy of the information and to stop using your information for a period of time if you believe we are not doing so lawfully.
